HOW CONSUMER LAW RELATES TO THIS WARRANTY

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE. OTHER THAN AS PERMITTED BY LAW, MAIN PERFORMANCE PC DOES NOT EXCLUDE, LIMIT OR SUSPEND OTHER RIGHTS YOU MAY HAVE, INCLUDING THOSE THAT MAY ARISE FROM THE NONCONFORMITY OF A SALES CONTRACT. FOR A FULL UNDERSTANDING OF YOUR RIGHTS YOU SHOULD CONSULT THE LAWS OF YOUR STATE.

WARRANTY LIMITATIONS THAT MAY AFFECT CONSUMER LAW

TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE REMEDIES SET FORTH ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. MAIN PERFORMANCE PC DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS, TO THE EXTENT PERMITTED BY LAW. IN SO FAR AS SUCH WARRANTIES CANNOT BE DISCLAIMED, MAIN PERFORMANCE PC LIMITS THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS WARRANTY AND, AT MAIN PERFORMANCE PC’S OPTION, THE REPAIR OR REPLACEMENT SERVICES DESCRIBED BELOW. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY (OR CONDITION) MAY LAST, SO THE LIMITATION DESCRIBED ABOVE MAY NOT APPLY TO YOU.

WHAT IS COVERED BY THIS WARRANTY?

Main Performance PC warrants the Main Performance PC-branded hardware product and accessories contained in the original packaging (“Main Performance PC Product”) against defects in materials and workmanship when used normally in accordance with Main Performance PC’s published guidelines for a period of the LIFETIME of the product from the date of original purchase by the end-user purchaser or second hand purchaser (“Warranty Period”). Main Performance PC’s published guidelines include but are not limited to information contained in technical specifications, user manuals and service communications. Main Performance PC, at it’s sole discretion, will provide free of charge any upgrades to existing product owners, that it deems to be reasonable enough to provide a meaningful enhancement in product quality or performance. The upgrade shall not apply to any design changes that would give the impression of or meant to be a newer version of the product, but only to enhancements in product reliability and performance, and the determination of which is soley up to the discretion of Main Performance PC.

WHAT IS NOT COVERED BY THIS WARRANTY?

This warranty does not apply to any non-Main Performance PC branded hardware products or any software, even if packaged or sold with Main Performance PC hardware. Suppliers, or publishers, other than Main Performance PC, may provide their own warranties to you but Main Performance PC, in so far as permitted by law, provides their products “AS IS”. Software distributed by Main Performance PC with or without the Main Performance PC brand (including, but not limited to System software) is not covered by this warranty. Please refer to the licensing agreement accompanying the software for details of your rights with respect to its use. Main Performance PC does not warrant that the operation of the Main Performance PC Product will be uninterrupted or error-free. Main Performance PC is not responsible for damage arising from failure to follow instructions relating to the Main Performance PC Product’s use.

This warranty does not apply: (a) to consumable parts, such as batteries, unless failure has occurred due to a defect in materials or workmanship; (b) to cosmetic damage, including but not limited to scratches, dents and broken plastic on ports; (c) to damage caused by use with another product; (d) to damage caused by accident, abuse, misuse, liquid contact, fire, earthquake or other external cause; (e) to damage caused by operating the Main Performance PC Product outside Main Performance PC’s published guidelines; (f) to damage caused by service (including upgrades and expansions) performed by anyone who is not a representative of Main Performance PC or an Main Performance PC Authorized Service Provider (“ASP”); (g) to an Main Performance PC Product that has been modified to alter functionality or capability without the written permission of Main Performance PC; (h) to defects caused by normal wear and tear or otherwise due to the normal aging of the Main Performance PC Product (i) if any serial number has been removed or defaced from the Main Performance PC Product or (j) if you have failed to return faulty hardware replaced under your warranty for a period of 30 days after receipt, failure to do so will void your warranty and support services.

OUT OF WARRANTY REPAIRS

Main Performance PC may agree to perform out of warranty repairs for additional fees.  An RMA is required prior to shipping your product back to us. To get an RMA authorization, you must contact us via https://support.mainperformancepc.com/hc/en-us and submit a ticket, where further instructions will be given. DO NOT SEND YOUR PRODUCT FOR REPAIR WITHOUT RMA AUTHORIZATION.

YOUR RESPONSIBILITIES

Before receiving warranty service, Main Performance PC or its agents may require that you furnish proof of purchase details, respond to questions designed to assist with diagnosing potential issues and follow Main Performance PC’s procedures for obtaining warranty service.

DURING WARRANTY SERVICE IT IS POSSIBLE THAT THE CONTENTS OF THE MAIN PERFORMANCE PC PRODUCT’S STORAGE MEDIA WILL BE LOST, REPLACED OR REFORMATTED. IN SUCH AN EVENT MAIN PERFORMANCE PC AND ITS AGENTS ARE NOT RESPONSIBLE FOR ANY LOSS OF CALIBRATION SETTINGS, DATA OR OTHER INFORMATION CONTAINED ON THE STORAGE MEDIA OR ANY OTHER PART OF THE MAIN PERFORMANCE PC PRODUCT SERVICED.

Following warranty service your Main Performance PC Product or a replacement product will be returned to you as your Main Performance PC Product was configured when originally purchased, subject to applicable updates. You will be responsible for recalibrating, data and information. Recovery and reinstallation of other software programs, data and information are not covered under this warranty.



TECHNICAL SUPPORT

As part of your warranty, Main Performance PC offers twenty four hour, seven days a week, three hundred and sixty five days a year support for your product. Main Performance PC warranties that it will be available to you for support during the period of your warranty. Our agreement to you is that we will return requests for support within 2 hours of receipt. This includes return calls to you, if the appropriate message is left during or after our normal business hours. For support tickets created through the proper channel, we will reply no later than 24 hours after receipt of such.

WHAT WILL MAIN PERFORMANCE PC DO IN THE EVENT THE WARRANTY IS BREACHED?

If during the Warranty Period you submit a valid claim to Main Performance PC, Main Performance PC will, at its option, (i) repair the Main Performance PC Product using new or previously used parts that are equivalent to new in performance and reliability, (ii) replace the Main Performance PC Product with a product that is at least functionally equivalent to the Main Performance PC Product and is formed from new and/or previously used parts that are equivalent to new in performance and reliability, or (iii) exchange the Main Performance PC Product for a refund of your purchase price.

Main Performance PC may request that you replace certain user-installable parts or products. A replacement part or product, including a user-installable part that has been installed in accordance with instructions provided by Main Performance PC, assumes the remaining warranty of the Main Performance PC Product or ninety (90) days from the date of replacement or repair, whichever provides longer coverage for you. When a product or part is replaced or a refund provided, any replacement item becomes your property and the replaced or refunded item becomes Main Performance PC’s property.

HOW TO OBTAIN WARRANTY SERVICE?

Please contact a Main Performance PC representative by phone at 1-877-677-2798 EXT 2 or, create a support ticket, using the information provided below. A Main Performance PC representative will help determine whether your Main Performance PC Product requires service and, if it does, will inform you how Main Performance PC will provide it. When contacting Main Performance PC via telephone, other charges may apply depending on your location. An RMA authorization is required for all warranty repairs/replacements. To get an RMA authorization, you must contact us via https://support.mainperformancepc.com/hc/en-us and submit a ticket, where further instructions will be given. DO NOT SEND YOUR PRODUCT FOR REPAIR WITHOUT RMA AUTHORIZATION.

WARRANTY SERVICE OPTIONS

Main Performance PC will provide warranty service through one or more of the following options:

(i) Mail-in service. If Main Performance PC determines that your Main Performance PC Product is eligible for mail-in service, you must mail Main Performance PC your product, the purchaser is responsible for packaging and shipping charges and any damage that may result in doing so. Once service is complete, Main Performance PC will return the Main Performance PC Product to you. Main Performance PC will pay for shipping to your location when repairs are finalized.

(ii) Do-it-yourself (DIY) parts service. DIY parts service allows you to service your own Main Performance PC Product. If DIY parts service is available in the circumstances, the following process will apply. All warranty replaced hardware MUST be returned to Main Performance PC within 30 days of receipt of the warranty replacement hardware. If an authorization for the replacement hardware was taken, you will be charged in full for the amount of the authorization if 30 days have passed. If no authorization was taken for hardware replaced, Main Performance PC has the right to void all future warranty & support for your product for the remainder of your term. Resolution after this period has gone into effect by the return of the missing hardware is the sole discretion of Main Performance PC.

(a) Service where Main Performance PC requires return of the replaced product or part. Main Performance PC may require a credit card authorization as security for the retail price of the replacement product or part and applicable shipping costs. If you are unable to provide credit card authorization, DIY parts service may not be available to you and Main Performance PC will offer alternative arrangements for service. Main Performance PC will ship a replacement product or part to you with installation instructions, if applicable, and any requirements for the return of the replaced product or part. If you follow the instructions, Main Performance PC will cancel the credit card authorization, so you will not be charged for the product or part and shipping to your location. If you fail to return the replaced product or part as instructed or return a replaced product or part that is ineligible for service, Main Performance PC will charge your credit card for the authorized amount.

(b) Service where Main Performance PC does not require return of the replaced product or part. Main Performance PC will ship you free of charge (USA ONLY) a replacement product or part accompanied by instructions on installation, if applicable, and any requirements for the disposal of the replaced product or part.

(c) Main Performance PC is not responsible for any labor costs you incur relating to DIY parts service. Should you require further assistance, contact Main Performance PC at the telephone number listed below.

Main Performance PC reserves the right to change the method by which Main Performance PC may provide warranty service to you, and your Main Performance PC Product’s eligibility to receive a particular method of service. Service will be limited to the options available in the state where service is requested. Service options, parts availability and response times may vary according to state. You may be responsible for shipping and handling charges if the Main Performance PC Product cannot be serviced in the state or country it is in. If you seek service in a country that is not the country of purchase, you will comply with all applicable import and export laws and regulations and be responsible for all custom duties, V.A.T. and other associated taxes and charges including shipping charges.

WARRANTY TERMS FOR OUTSIDE OF THE UNITED STATES (REST OF THE WORLD)

Main Performance PC’s Limited Lifetime Warranty is extended to those outside of the United States, however shipping costs for repairs/replacements is the responsibility of the customer both to and from Main Performance PC.  Main Performance PC does not provide free return shipping outside of the US, and for Warranty Service we will provide flat rate shipping to you at the cost of $25 flat fee via USPS for a small flat rate box, or $78.00 for a 12X12X5 1/2 Large Flat Rate Box – for example, a replacement pedal assembly would require the large flat rate box. Additional shipping options may be available, please contact us for quotes. Failure to return hardware replaced for you under warranty may result in your warranty being voided per the terms described earlier in this warranty document.

LIMITATION OF LIABILITY

EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAIN PERFORMANCE PC IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO, COMPROMISE OR CORRUPTION OF DATA; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER CAUSED INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY, ANY COSTS OF RECOVERING, PROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA STORED IN OR USED WITH THE MAIN PERFORMANCE PC PRODUCT OR ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF INFORMATION STORED IN THE MAIN PERFORMANCE PC PRODUCT.

THE FOREGOING LIMITATION SHALL NOT APPLY TO DEATH OR PERSONAL INJURY CLAIMS, OR ANY STATUTORY LIABILITY FOR INTENTIONAL AND GROSS NEGLIGENT ACTS AND/OR OMISSIONS. MAIN PERFORMANCE PC DISCLAIMS ANY REPRESENTATION THAT IT WILL BE ABLE TO REPAIR ANY MAIN PERFORMANCE PC PRODUCT UNDER THIS WARRANTY OR REPLACE THE MAIN PERFORMANCE PC PRODUCT WITHOUT RISK TO OR LOSS OF INFORMATION STORED ON THE MAIN PERFORMANCE PC PRODUCT.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

PRIVACY

Main Performance PC will maintain and use customer information in accordance with the Main Performance PC Customer Privacy Policy available at https://www.mainperformancepc.com/privacy-policy/

GENERAL

No Main Performance PC reseller, agent, or employee is authorized to make any modification, extension, or addition to this warranty. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired. This warranty is governed by and construed under the laws of the country in which the Main Performance PC Product purchase took place. Main Performance PC is identified at the end of this document according to the country or region in which the Main Performance PC Product purchase took place. Main Performance PC or its successor in title is the warrantor under this warranty.
